General Terms of Use

User Status

Access to and/or use of the Website confers the status of User, who accepts these Legal Conditions from such access. The User must carefully read this Legal Notice each time they intend to use the Website, as it may be subject to modifications.

Purpose of the Website

The Website provides access to services offered by Restoo consisting of design, development, hosting of web pages and management solutions in the restaurant sector, particularly a digital reservation book.

The Website owner may offer services or products subject to specific conditions which, where applicable, replace, supplement or modify these Conditions. The User will be informed in each specific case.

Limitation of Liability for Website Use

The User assumes responsibility for use of the Website and undertakes to make appropriate use of the content and services provided, and not to use them for unlawful activities, illegal acts, acts contrary to good faith and public order; to disseminate racist, xenophobic, illegal pornographic, terrorist or human rights violating content; or to cause damage to Restoo's systems or those of third parties.

Restoo shall not be liable for opinions expressed by Users through forums, chats or other participation tools.

Where the Website contains links to third-party sites, Restoo does not control their content and assumes no responsibility for them, nor does it guarantee their technical availability, reliability or accuracy.

Intellectual Property

Restoo, either directly or as assignee, owns the intellectual and industrial property rights of all elements contained in the domains restoo.me and myrestoo.net, including but not limited to graphic design, logos, texts, graphics and illustrations.

All trade names, trademarks and distinctive signs are protected by law.

Reproduction, distribution or public communication of all or part of the Website contents for commercial purposes without express authorization from Restoo is strictly prohibited.

The User must respect Restoo's intellectual and industrial property rights. Content may only be used for personal and private purposes.

Applicable Law and Jurisdiction

The relationship between Restoo and the User shall be governed by Spanish law. Any disputes shall be submitted to the Courts of Madrid.

Privacy Policy

The GDPR and Spanish data protection law establish valid legal bases under which personal data may be processed. Those applicable to Restoo are as follows:

Legal Basis: Consent

  • It requires specific, informed and unambiguous consent, freely given through a clear affirmative action.
  • Individuals must be informed that they have the right to refuse consent.
  • Consent must be given by a person who has reached the age of consent established in the relevant Member State. Otherwise, a parent or legal guardian must give or authorize consent.
  • For certain processing operations, such as special categories of personal data, explicit consent is required.

Restoo's Role in Data Processing

An organization may act as a Controller, also known as a Data Controller, or as a Processor, also known as a Data Processor. Both roles may apply to the same organization, with specific responsibilities in each case.

Data Controller

A company acts as a data controller when it is responsible for deciding why, for what purpose and how personal data is processed, meaning that it has decision-making authority over the purposes and means of processing.

Under the GDPR, data controllers must implement compliance measures covering how data is collected, what it is used for and how long it is retained. They must also ensure that individuals can access the data held about them.

Data controllers must ensure that data processors comply with their contractual commitments to process data securely and lawfully.

Restoo acts as data controller for the data of our direct customers, namely the establishments that contract our reservation book.

Data Processor

A company acts as a data processor when it processes personal data on behalf of a data controller. Under the GDPR, data processors are required to process data securely and lawfully.

Restoo acts as data processor for the data of users of our customers' reservation books. It also acts as processor when carrying out surveys, usage statistics and performance measurement, and when measuring the reach of marketing campaigns and preparing the corresponding reports. As processor, Restoo informs the controller of the need to comply with the relevance requirement regarding the users' data being processed. The Restoo service is NOT designed for the processing of personal data contained in image format.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, the General Data Protection Regulation, and Organic Law 3/2018 of December 5 on Personal Data Protection and Guarantee of Digital Rights, hereinafter the LOPD, Restoo informs customers and Website users of the following:

I. Any personal data provided, or to be provided, will be included in a duly registered automated processing system.

II. Purpose. The data will be used solely to respond to the User's and/or Customer's request, to send commercial communications where expressly authorized, and to prepare statistics.

III. Restoo informs users that it guarantees the security of the data and keeps it in the strictest confidence. It has adopted all necessary technical and organizational measures to guarantee the security and integrity of the personal data it processes, and to prevent its loss, alteration and/or access by unauthorized third parties.

IV. Restoo expressly informs and guarantees Users and Customers that their personal data will not be transferred to third-party companies under any circumstances and that, whenever any type of personal data transfer is to be carried out, the prior, express, informed and unambiguous consent of the data subjects will be requested.

V. Restoo informs users that it does not use data for profiling.

VI. Restoo does not store any confidential banking information and has implemented the highest levels of encryption for financial transactions. For this reason, we work with one of the most reputable companies in payment intermediation: Stripe. Stripe is responsible for collecting payments, so it is not necessary to store any confidential banking information on our servers.

VII. Where data is requested for the provision of services, if such data is not provided completely, appropriately or truthfully, Restoo does not guarantee that the information and services provided will fully meet your needs.

VIII. Control of Personal Data. Restoo guarantees Users and Customers, in all cases, their right to review, correct and delete their personal data by exercising the rights of access, rectification, erasure, information and objection, under the terms established by applicable law. To do so, they may exercise their rights by sending an express request, with the reference "Personal data", together with a copy of their official identity document, DNI, NIE or Passport, through the following channels:

IX. Deletion of data from Meta (Facebook/Instagram). If you have used your Facebook or Instagram account to log in, make reservations or interact with our services, you may request the complete deletion of the personal data we have received through Meta platforms.

To exercise this right:

1. Send an email to hola@restoo.me with the subject line 'Meta data deletion'.

2. Include your full name and the email address or identifier associated with your Facebook or Instagram account.

3. We will delete the linked personal data within a maximum period of 30 calendar days, except for data that we must retain due to a legal obligation or for security reasons.

Once the process has been completed, we will not retain any personal data from Meta Platforms, Inc. or from its network integrations.

Restoo may need to use data sub-processors to support the provision of the services requested by and provided to the Customer, without which we would not be able to offer our services properly.

Unsubscribing from Our Communications

Likewise, the User and/or Customer may unsubscribe from any of our communications by clicking the unsubscribe section included in electronic communications sent by Restoo.

Unsubscribing from Our Customers' Communications

Our customers are solely and directly responsible for any marketing or other communications they may send, so we cannot unsubscribe you from their communications. The User may unsubscribe from our customers' communications by clicking the "unsubscribe" link located at the end of the relevant communication or by contacting them directly.

Where applicable, you may also contact the supervisory authorities in Spain, namely the Spanish Data Protection Agency, located at C/ Jorge Juan, no. 6, 28001 Madrid.

IX. Retention period. This data will be kept for the time strictly necessary to provide the services and comply with the legal obligations arising from them, or to fulfill a duly balanced legitimate interest. Once the services have been provided or where there is no legitimate interest, Restoo will block the data and may carry out an anonymization process for statistical purposes.

Social Networks

Restoo currently has profiles on different social networks: Facebook, Twitter, Vimeo, Flickr, Google+, Slideshare, YouTube and Pinterest.

The data processing carried out by Restoo as controller of such data is the processing permitted by each social network for the profiles available on them. The aforementioned social networks will be used to provide information about the company's activities. In any case, Restoo will not export data from the different social networks unless the User/Customer has previously and expressly given consent for a specific purpose.

Each of these networks is governed by its own legal terms and conditions, which are separate from Restoo.

Social Network Plugins and Other Services

Restoo offers the possibility of integration with third-party services.

Restoo has no influence over the scope of the data collected by social networks and third-party services; Restoo merely acts as a connector to these services. We therefore recommend that you consult the privacy policy of the relevant social network and/or third-party service regarding the type, scope and purpose of data collection, information on further processing of the data, and your rights and options for protecting your privacy. Restoo does not disclose our customers' data to these social networks and/or third-party services.
